Your agreement with SmartlyServe Ltd

๐Ÿ“Œ By creating a SmartlyServe account you agree to these terms. Please read them carefully. The key points: you own your data, we provide the platform, you pay the fees, and either party can end the agreement with notice.

1. Definitions

"Service" means the SmartlyServe bakery management platform and all associated features. "Customer", "you", "your" means the business or individual who signs up. "We", "us", "SmartlyServe" means SmartlyServe Ltd. "User" means any person who accesses the Service on your account.

SmartlyServe is available on monthly or annual subscription plans. Plan details, features and current pricing are at smartlyserve.com/#pricing.

We will give 30 days notice of any price increase. Continued use after the effective date constitutes acceptance.

4.4 Free Trial

New accounts receive a 14-day free trial with full Professional features. No credit card required. At trial end your account continues on the Starter plan or you can choose a paid plan.

We may suspend or terminate accounts that violate these Terms, are involved in fraud, or after extended non-payment (30+ days overdue). We'll provide notice where practicable except in cases of serious violations.

8. Limitation of Liability

To the maximum extent permitted by law: the Service is provided "as is". We are not liable for: indirect, incidental or consequential damages; loss of profits or revenue; loss of data; or any damages exceeding the fees you paid us in the 3 months preceding the claim.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

9. Indemnification

You agree to indemnify SmartlyServe against claims arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Governing Law

These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to mandatory consumer protection laws in your local jurisdiction.

11. Changes to Terms

We'll notify you of material changes with at least 30 days notice by email and in-app notice. Continued use after the effective date constitutes acceptance of the updated Terms.
